Smith Mueller recently won a trial without calling a single live witness! Mike and Tricia defended the owner and tenant of a building located in the City of St. Louis against a slip and fall claim. A patron of the tenant alleged she had slipped in water on the floor of the building and claimed severe and permanent injuries. She claimed Smith Mueller’s clients were negligent in failing to either remove the water or warn of its existence. The tenant was no longer in business and no witnesses to the event were to be found. Through extensive and thorough pre-trial investigation, the attorneys at Smith Mueller discovered and brought into evidence the fact that plaintiff had claimed similar injuries from other incidents, indicating that she did not suffer any injuries in her alleged fall. After Smith Mueller obtained a directed verdict on behalf of the owner of the building, the jury took under 30 minutes to find in favor of the the tenant.
